Introduction

1. About Fastrove
   Fastrove is a digital fashion marketplace that connects independent fashion vendors with customers through its website and mobile application (the “Platform”). The Platform enables vendors to showcase, market, and sell authentic African fashion products while providing customers with a convenient and secure shopping experience. These Terms and Conditions (“Terms”) govern access to and use of the Platform, including all services, features, content, and functionalities offered by Fastrove.
   
   

2. Acceptance of Terms
   By accessing, registering for, or using the Platform, you acknowledge that you have read, understood, and agreed to be bound by these Terms and any policies referenced herein. If you do not agree with these Terms, you must not use the Platform.
   
   

3. Business Use
   Where you use the Platform on behalf of a company, fashion brand, partnership, or other organisation, you represent and warrant that you have the authority to bind that entity to these Terms. In such cases, references to “you” or “user” shall include the organisation you represent.
   
   

Account Registration

1. Eligibility
   You must be at least eighteen (18) years old to create an account, make purchases, sell products, or otherwise use the Platform. By registering an account, you confirm that you meet this requirement.
   
   

2. Account Responsibilities
   When creating an account, you agree to: 

   • Provide accurate, complete, and up to date information 

   • Maintain the confidentiality of your username, password, and other login credentials

   • Immediately notify Fastrove of any unauthorised access or suspected security breach affecting your account

   • Accept responsibility for all activities conducted through your account, whether authorised by you or not

   Accounts are personal and may not be transferred, assigned, sold, rented, or shared with another person without Fastrove's prior written consent.
   
   

3. Account Suspension or Termination
   Fastrove reserves the right to suspend, restrict, or permanently terminate any account that:

   • Violates these terms

   • Engages in fraudulent, deceptive, or unlawful activities

   • Compromises the security or integrity of the Platform

   • Negatively impacts other users or the reputation of Fastrove
     
     

Marketplace Transactions

1. Role of Fastrove
   Fastrove operates solely as an online marketplace that facilitates transactions between independent vendors and customers. Unless expressly stated otherwise, Fastrove is not the seller, manufacturer, importer, or owner of products listed by vendors. The contract for the purchase and sale of products is formed directly between the customer and the relevant vendor.
   
   

2. Product Listings
   Vendors are solely responsible for ensuring that product listings are accurate and lawful. Vendors must ensure that:

   • Product descriptions accurately reflect the item being sold

   • Prices are correctly stated and updated

   • Products are authentic, legal, and available for sale

   • Photographs and images accurately represent the products listed.
     Fastrove reserves the right to remove or modify listings that violate these Terms or applicable laws.
     
     

3. Purchases
   By placing an order through the Platform, customers agree to purchase the selected products subject to vendor acceptance, product availability, successful payment processing, and compliance with these Terms.
   
   

4. Pricing
   All prices displayed on the Platform shall include applicable taxes where required by law. Additional costs, including delivery fees and service charges, shall be displayed clearly before checkout.
   
   

Payments

1. Secure Payments
   Fastrove uses secure payment technologies and third party payment providers to facilitate transactions. Payments may be temporarily held or delayed where verification, fraud prevention, or delivery confirmation procedures apply.
   
   

2. Payment Methods
   Customers agree to use only payment methods approved and made available through the Platform.
   
   

3. Failed or Fraudulent Transactions
   Fastrove reserves the right to refuse, suspend, investigate, or cancel transactions where there is reasonable suspicion of fraud, unauthorised activity, money laundering, payment abuse, or breach of these Terms.
   
   

Delivery, Returns and Refunds

1. Delivery
   Fastrove works with vendors and third party logistics partners to facilitate product delivery. Delivery times are estimates only and may vary depending on location, customs requirements, courier operations, and other external factors.
   
   

2. Returns
   Customers may request returns for eligible products in accordance with Fastrove's Returns Policy. Returned products must meet all applicable return requirements, including condition, packaging, and return deadlines.
   
   

3. Refunds
   Refunds may be approved where: 

   • The product is damaged upon delivery

   • The wrong product was delivered 

   • The product is defective 

   • The product was not successfully delivered

   Refund processing times may vary depending on the payment provider and financial institution involved.
   
   

Vendor Responsibilities
Vendors using Fastrove agree to: 

• Sell authentic, lawful, and compliant products

• Maintain accurate inventory records

• Fulfil orders professionally and within agreed timelines

• Communicate respectfully and honestly with customers

• Avoid misleading promotions, deceptive pricing, or false advertising. 

Fastrove reserves the right to remove products, restrict vendor privileges, or terminate vendor accounts that fail to meet marketplace standards.

User Content, Reviews And Contributions

1. User Generated Content
   Users may upload reviews, comments, ratings, photographs, videos, suggestions, feedback, and other materials ("Contributions") to the Platform.
   
   

2. License Granted to Fastrove
   By submitting Contributions, users grant Fastrove a worldwide, non-exclusive, royalty-free, transferable licence to use, reproduce, publish, modify, distribute, display, promote, and otherwise exploit such Contributions for business, marketing, advertising, and operational purposes.
   This license shall remain valid for ten (10) years from submission or for any longer period permitted under applicable law.
   
   

3. User Warranties
   You warrant that:

   • You own or have permission to use and submit the Contribution

   • The Contribution does not infringe any intellectual property rights

   • The Contribution is truthful and accurately reflects your experience

   • The Contribution does not violate any law or regulation.
     
     

4. Prohibited Content
   Users must not submit content that is:

   • False, deceptive, or misleading

   • Defamatory, abusive, or offensive

   • Discriminatory, hateful, or threatening

   • Unlawful or fraudulent

   • Infringing upon intellectual property rights

   • Harmful to other users or the Platform.

   Fastrove reserves the right to remove any content that violates these Terms.
   
   

5. License to Use Contributions
   By submitting, posting, uploading, publishing, or otherwise making available any review, rating, comment, image, video, feedback, suggestion, idea, recommendation, or other user-generated content ("Contribution") on the Platform, you grant Fastrove, its affiliates, partners, service providers, successors, and assigns a worldwide, non-exclusive, royalty-free, transferable, sublicensable licence to use such Contribution for commercial, promotional, operational, advertising, marketing, and business purposes.
   
   This license includes the right to:

   • Reproduce, copy, store, and display all or part of the Contribution on the Platform or through any other media

   • Publish, communicate, distribute, broadcast, or otherwise make the Contribution available to the public

   • Modify, edit, adapt, translate, reformat, resize, enhance, or create derivative works from the Contribution where legally permitted

   • Use, commercialise, promote, and otherwise exploit the Contribution in connection with Fastrove's business operations, products, services, promotional campaigns, and marketing activities

   • Share, sublicense, transfer, assign, or grant rights relating to the Contribution to third parties engaged by Fastrove for legitimate business purposes.

   The rights granted under this section apply across all media formats, communication channels, technologies, and platforms now known or developed in the future, and may be exercised globally without compensation or further approval from the user, except where prohibited by applicable law.
   
   

6. User Warranties and Representations
   By submitting a Contribution, you represent and warrant that:

   • You are the creator, owner, or authorised rights holder of the Contribution and have the legal authority to grant the rights described in these Terms

   • The Contribution does not infringe the copyright, trademark, privacy, publicity, intellectual property, or other rights of any third party

   • The Contribution is non-confidential and non-proprietary in nature

   • The Contribution has been submitted by you and does not impersonate, misrepresent, or falsely identify another person, business, or organisation

   • The Contribution accurately reflects your genuine experience, opinion, or interaction with the Platform, products, or services

   • You are at least eighteen (18) years of age, or otherwise legally authorised to submit the Contribution under applicable law

   • The Contribution complies with these Terms, Fastrove's Reviews Policy, applicable laws, and community standards

   • The Contribution is suitable for a general audience and does not contain inappropriate or harmful material.
     
     

7. Prohibited Contributions
   Users agree that neither their use of the Platform nor any Contribution submitted to the Platform shall contain, promote, encourage, or otherwise involve:

   • Sexually explicit, pornographic, obscene, or adult content

   • Content that the user does not own or have permission to publish

   • Discriminatory, hateful, defamatory, racist, sexist, abusive, or derogatory content directed at any individual or group

   • Threats, intimidation, harassment, stalking, or bullying

   • Content that promotes violence, criminal activity, terrorism, extremism, or dangerous conduct

   • Misleading, false, deceptive, or fraudulent information

   • Illegal products, controlled substances, unlawful gambling, or other prohibited activities

   • False or misleading medical, health, or safety claims

   • Content that infringes intellectual property rights or privacy rights

   • Content that is unlawful, offensive, or otherwise prohibited under applicable laws or regulations

   • Content that may reasonably be considered harmful to minors, vulnerable persons, or the wider community.
     
     

8. Moderation and Enforcement
   Fastrove does not routinely monitor, review, or verify all Contributions submitted by users before publication. However, Fastrove reserves the right, at its sole discretion, to review, remove, restrict, block, suspend, edit, or disable access to any Contribution that it believes:

   • Violates these Terms

   • Infringes the rights of any person or entity

   • Poses a legal, reputational, security, or operational risk to Fastrove or its users

   • Contains illegal, harmful, or misleading content.

   Users acknowledge that violations of this section may result in content removal, account restrictions, temporary suspension, permanent account termination, or legal action where appropriate. Where content has been removed or access restricted, users may contact Fastrove Customer Support to request a review of the decision.
   
   

9. Responsibility for User Content
   Users remain solely responsible for all Contributions they submit to the Platform. Fastrove accepts no responsibility or liability for any user generated content and disclaims all liability arising from Contributions posted by users. The views, opinions, recommendations, and statements expressed by users are their own and do not necessarily reflect the views, opinions, or values of Fastrove.
   
   

Platform Usage Rules
Users agree not to: 

• Attempt to hack, disrupt, interfere with, or compromise the Platform

• Use automated bots, crawlers, scrapers, or data mining tools without authorisation

• Engage in fraud, money laundering, or deceptive conduct

• Circumvent Fastrove's payment systems or transaction processes

• Solicit buyers or vendors outside the Platform to avoid fees or marketplace protections

• Introduce viruses, malware, or harmful code into the Platform.

Fastrove may restrict access or take legal action against users who violate these rules.

Intellectual Property

1. Ownership of the Fastrove Platform and Content
   The Fastrove website, mobile app, and all non-product specific materials available on the platform, including text, software, scripts, graphics, photos, music, videos, and interactive features (collectively called “Platform Content”) are owned by Fastrove, its partners, or third party licensors. These materials are protected by copyright, trademark, and other intellectual property laws. All rights not expressly granted to users under these Terms & Conditions are reserved. Product related content such as product photos, descriptions, videos, and branding uploaded by vendors (collectively “Product Content”) is owned by the respective vendor, their affiliates, or third parties who have licensed the materials to them. Vendors are responsible for ensuring they have the rights to use and upload such content. 

   All Platform Content and Product Content are provided solely for personal and private use. Users may not use any part of the platform or its content for commercial purposes unless they have received written permission from Fastrove or the relevant vendor. Fastrove and vendors may update, modify, or remove content at any time without notice. Users may not download, copy, reproduce, distribute, transmit, broadcast, display, sell, license, or exploit any part of the Platform Content or Product Content without prior written approval from Fastrove or the respective rights holder.
   Users also agree not to:

   1. Circumvent or interfere with any security features or usage restrictions on the platform.

   2. Perform data extraction, scraping, or automated data collection.

   3. Introduce harmful code, malware, or any activity that could damage or disrupt the platform.
      
      

2. Fastrove Trademarks and Brand Assets
   All Fastrove names, logos, icons, graphics, and brand elements (collectively “Fastrove Marks”) displayed on the platform or in communications are the exclusive property of Fastrove and its affiliates. These marks may not be copied, used, reproduced, or referenced without Fastrove’s prior written consent. Any other trademarks or brand elements displayed on product listings belong to the respective vendors or their suppliers. Users acknowledge that they do not acquire any rights or interest in Fastrove Marks or any vendor trademarks by using the platform.
   
   

3. Vendor Trademarks and Brand Rights
   Each vendor on Fastrove owns the trademarks, service marks, logos, and brand identifiers associated with their products (collectively “Vendor Marks”). Users may not use, reproduce, distribute, or reference Vendor Marks for commercial purposes without written permission from the vendor. All other marks not owned by vendors belong to their respective licensors. Users do not gain any rights to Vendor Marks by browsing or purchasing products on Fastrove.
   
   

   1. Reviews, Contributions & User Generated Content (UGC)
      When users submit reviews, comments, photos, videos, suggestions, ideas, or any form of content on the Fastrove platform (collectively “Contributions”), they grant Fastrove and its affiliates a free, worldwide, non-exclusive licence to use, display, reproduce, distribute, modify, adapt, and publish the content for up to ten (10) years, or longer where legally permitted. This licence allows Fastrove to:

      1. Use Contributions for marketing, product improvement, customer support, or promotional purposes.

      2. Display the user’s name or username alongside their Contribution when necessary.

      3. Sub-license or share Contributions with partners, service providers, or vendors where relevant.

      Users will not receive compensation for their Contributions and waive any moral rights to the extent permitted by law. Contributions must not violate any intellectual property rights, contain harmful or illegal content, or misrepresent products or experiences.
      
      

4. Promotions, Competitions and Online Games
   From time to time, Fastrove may offer competitions, giveaways, promotional campaigns, vouchers, coupons, loyalty rewards, or interactive games through the Platform. Participation in such promotions may be subject to additional rules, eligibility requirements, and promotional terms ("Promotion Rules"). Users must review and accept the applicable Promotion Rules before participating. Fastrove reserves the right to modify, suspend, or withdraw any promotion, competition, or game at any time in accordance with applicable laws.
   
   

5. Extended Rights to Use Contributions
   When you submit any review, comment, photo, video, idea, suggestion, or other form of user generated content on Fastrove (your “Contribution”), you grant Fastrove a free, worldwide licence to use that content for commercial, promotional, and marketing purposes. This licence allows Fastrove to use your Contribution in many ways that support the platform and its community.

   • Rights Granted to Fastrove
     This license includes the right for Fastrove to:

     1. Reproduce your Contribution; meaning Fastrove may copy or have it copied, in whole or in part.

     2. Display or communicate your Contribution publicly including showing it on the app, website, social media, or other channels.

     3. Modify, translate, or adapt your Contribution, where legally allowed, for example, adjusting formatting, resizing images, or translating text.

     4. Use or exploit your Contribution for Fastrove’s business purposes or for the benefit of selected third parties such as marketing partners or service providers.

     5. Assign or license these rights to any company, partner, or entity chosen by Fastrove, whether free or paid, where legally permitted.

     These rights apply across all formats, all media types, all languages, and all technologies, whether existing today or developed in the future.
     
     

   • Your Guarantees About Your Contribution
     By submitting a Contribution, you confirm that:

     1. You are the creator or legal owner of the content and sharing it on Fastrove does not violate anyone else’s rights.

     2. Your Contribution is not confidential and may be treated as non-proprietary.

     3. You submitted the Contribution using your own account and did not impersonate anyone.

     4. Your Contribution is truthful and reflects your genuine experience with Fastrove or a product purchased on the platform.

     5. You are at least 18 years old, or you have permission from a parent or legal guardian if required by law.

     6. Your Contribution does not violate Fastrove’s Terms & Conditions, any applicable laws, or the rights of any person or entity.

     7. Your Contribution complies with Fastrove’s Reviews Policy.

     8. Your Contribution is appropriate for a general, family friendly audience.
        
        

   • Prohibited Content
     You agree that neither your use of Fastrove nor your Contributions will involve or promote any of the following:

     1. Sexually explicit, pornographic, or adult content.

     2. Content you do not have permission or legal rights to share.

     3. Derogatory, hateful, discriminatory, or abusive comments targeting individuals or groups.

     4. Encouragement of violence, dangerous behaviour, or self harm.

     5. Terrorism, criminal activity, or illegal behaviour.

     6. Insensitive or offensive comments about tragedies, disasters, deaths, or crises.

     7. Harassment, intimidation, bullying, or threats.

     8. Promotion or sale of dangerous items, illegal drugs, or misuse of alcohol/tobacco.

     9. Content that infringes intellectual property rights.

     10. Desecration or disrespectful content.

     11. Any content you are not legally allowed to post or display.

     12. Any content considered illegal, harmful, or offensive under applicable laws.
         
         

   • Fastrove’s Rights Regarding Contributions
     You acknowledge and agree that:

     1. Fastrove does not control or pre-approve Contributions before they appear on the platform.

     2. Fastrove may, at its discretion, remove, block, or suspend any Contribution that violates the Terms & Conditions, applicable laws, or third-party rights.

     3. Such violations may lead to temporary or permanent suspension of your Fastrove account.

     4. You may challenge Fastrove’s decision by contacting Customer Support if your Contribution or account is removed or suspended.

     5. You are fully responsible for your Contributions, and Fastrove is not liable for any loss or damage resulting from them.

     6. Fastrove is not responsible for the views expressed by other users; these do not represent Fastrove’s values or opinions.

6. Intellectual Property Infringement and Product Content
   Fastrove respects intellectual property rights and expects vendors and users to do the same. As a marketplace operator, Fastrove does not actively monitor every product listing, image, description, trademark, design, or other content uploaded by vendors. Vendors remain solely responsible for ensuring that their products and content do not infringe the rights of third parties. However, Fastrove reserves the right to conduct investigations, review reported content, and remove or disable access to any product, listing, image, or content that is believed to be unlawful, dangerous, counterfeit, infringing, misleading, or otherwise in breach of these Terms or applicable laws.
   If a user, rights holder, or third party believes that any product or content on the Platform infringes intellectual property rights, they may submit a complaint through Fastrove's Intellectual Property Reporting Procedure. Upon receiving a valid complaint, Fastrove may investigate the matter and take appropriate action, including removing content, restricting listings, suspending accounts, or implementing preventative measures to avoid future infringements.
   
   

Privacy and Data Protection
Fastrove is committed to protecting the privacy and personal information of all users in accordance with its Privacy Policy and applicable data protection laws within its operating territories. When using the Platform, users acknowledge that Fastrove may collect, store, process, and use personal information such as names, contact details, delivery addresses, payment information, device identifiers, browsing behaviour, and transaction history. This information is used to operate the Platform, process orders, improve user experience, enhance security, and comply with legal obligations.
Fastrove implements administrative, technical, and organisational safeguards to protect personal data against loss, misuse, unauthorised access, disclosure, alteration, or destruction. These safeguards may include encryption, access controls, fraud detection systems, secure payment gateways, and regular security assessments. While Fastrove strives to maintain a secure environment, no online system is completely immune to risks, and users acknowledge that data transmission over the internet carries inherent vulnerabilities.
Users agree not to misuse, harvest, scrape, or exploit any personal information belonging to customers, vendors, or other users obtained through the Platform. This includes, but is not limited to, using such data for unsolicited marketing, harassment, fraud, identity theft, or any activity that violates privacy laws or Fastrove’s policies. Any misuse of personal data may result in immediate account suspension, legal action, or reporting to relevant authorities. Users are encouraged to review Fastrove’s Privacy Policy to understand how their data is collected, used, shared, and protected.

Limitation of Liability
Fastrove aims to provide a secure, reliable, and seamless marketplace experience; however, the Platform is provided on an “as is” and “as available” basis. Fastrove does not guarantee uninterrupted access, error free performance, or that the Platform will always operate without delays, disruptions, or technical issues.
To the fullest extent permitted by law, Fastrove shall not be liable for:

1. Service interruptions, including downtime, maintenance periods, system failures, or connectivity issues.

2. Third party logistics delays, including courier errors, delivery failures, customs delays, or issues caused by external delivery partners.

3. Vendor related disputes, including product quality issues, misrepresentation, late fulfilment, or vendor misconduct.

4. Losses resulting from misuse of the Platform, including fraudulent transactions, unauthorised account access, or violations of these Terms by users.

5. Events beyond Fastrove’s reasonable control, such as natural disasters, strikes, power outages, cyber attacks, pandemics, government restrictions, or other force majeure events.

Fastrove is not responsible for indirect, incidental, punitive, or consequential damages, including loss of profits, loss of data, loss of business opportunities, or reputational harm arising from the use or inability to use the Platform. Users acknowledge that Fastrove acts primarily as an intermediary between vendors and customers and is not the manufacturer, owner, or controller of products sold on the Platform. As such, Fastrove is not liable for product defects, safety issues, or intellectual property infringements arising from vendor supplied products or content.

Suspension and Enforcement
Fastrove reserves the right to investigate any suspected breach of these Terms and to take appropriate enforcement actions to protect the integrity of the Platform. Fastrove may temporarily or permanently suspend, restrict, or terminate user accounts found to be involved in:

1. Fraudulent activity, including payment fraud, identity theft, or manipulation of transactions.

2. Abuse, harassment, threats, or harmful behaviour toward customers, vendors, or Fastrove staff.

3. Fake transactions, fake reviews, or attempts to artificially influence ratings or marketplace performance.

4. Intellectual property violations, including uploading counterfeit products or infringing content.

5. Illegal conduct, including the sale of prohibited items, money laundering, or activities that violate applicable laws.

Fastrove may also remove listings, block content, cancel orders, or restrict access to certain features where necessary to protect users or comply with legal obligations. Users whose accounts are suspended may contact Fastrove’s support team to request clarification or appeal the decision. Fastrove reserves the right to deny reinstatement where violations are severe or repeated.

Changes to These Terms
Fastrove may update, revise, or modify these Terms and Conditions from time to time to reflect changes in legal requirements, platform features, business operations, or user needs. When updates occur, Fastrove will revise the “Last Updated” date and may notify users through email, in-app notifications, or announcements on the Platform.
Continued use of the Platform after such updates constitutes acceptance of the revised Terms. Users who do not agree with the updated Terms must discontinue use of the Platform.

Governing Law
These Terms and Conditions are governed by the applicable laws within the operating territory of Fastrove. Any disputes, claims, or legal proceedings arising from the use of the Platform shall be resolved exclusively by the competent courts within that jurisdiction. Users agree to submit to the personal and exclusive jurisdiction of these courts and acknowledge that these Terms do not limit any statutory consumer rights available under local law.
